45 COR 40-7961 [¶22,796] INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – CONSTRUCTION SAFETY ORDERS Cal. Code Regs, tit. 8, §§ 1509(a), 3203(a) (2018) – Employer failed to establish, implement and maintain an effective IIPP in accordance with §3203(a) of the General Industry Safety Orders. Employer failed to conduct daily inspections of a vehicle and aerial device or implement written emergency procedures to lower the aerial device should the operator be unable to operate the upper control. PERSONAL SAFETY DEVICES AND SAFEGUARDS – HEAD PROTECTION Cal. Code Regs, tit. 8, § 3381(a) (2018) – Employer failed to ensure that an employee was wearing head protection at the time of the accident. VEHICLES, TRAFFIC CONTROL, FLAGGERS, BARRICADES, AND WARNING SIGNS – TRAFFIC CONTROL FOR PUBLIC STREETS AND HIGHWAY Cal. Code Regs, tit. 8, § 1598(a) (2018) – Employer failed to ensure that an employee implemented traffic controls while working in a public street. SAFE PRACTICES AND PERSONAL PROTECTION – MACHINERY AND EQUIPMENT, INSPECTED AND MAINTAINED AS RECOMMENDED BY MANUFACTURER Cal. Code Regs, tit. 8, § 3328(b) (2018) – Employer failed to ensure that inspections were conducted and maintained on the upper controls in an aerial device in accordance with the manufacturer’s recommendations. ELEVATING WORK PLATFORMS AND AERIAL DEVICES – OPERATING INSTRUCTIONS (AERIAL DEVICES) Cal. Code Regs, tit. 8, § 3648(o) (2018) – Employer failed to ensure that an employee was secured to the basket of an aerial device through use of a safety strap. With exercise of reasonable diligence, Employer would have known of the violation. SAFE PRACTICES AND PERSONAL PROTECTION – MACHINERY AND EQUIPMENT IN SERVICE MAINTAINED IN SAFE OPERATING CONDITION Cal. Code Regs, tit. 8, § 3328(g) (2018) – Employer failed to ensure that an aerial device’s basket upper controls were in safe operating condition. With exercise of reasonable diligence, Employer would have known of the violation. INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – METHODS AND/OR PROCEDURES FOR CORRECTING UNSAFE OR UNHEALTHY CONDITIONS Cal. Code Regs, tit. 8, § 3203(a)(6)(A) (2018) – Employer failed to correct an unsafe condition, a missing midrail, when it was observed and discovered by Employer.
