ACCESS AND EGRESS - ELEVATORS FOR HOISTING WORKERS
Cal. Code Regs, tit. 8, § 1630(a) (2011) - Employer’s employees were constructing a 65-foot tall building. Employer did not install a construction passenger elevator for hoisting workers. The Division established a violation, but the ALJ reduced the penalty based on severity, extent and likelihood factors. 

ERECTION OF STRUCTURES - PERIMETER COLUMNS
Cal. Code Regs, tit. 8, § 1710(g)(6)(B) (2011) - Perimeter columns erected on a building that Employer was constructing did not have holes or other devices attached at 42 to 45-inches above the finished floor and the midpoint between the finished floor and the top cable to permit installation of perimeter safety cables. However, the Division failed to prove that an employee was exposed to any hazard. 

ERECTION OF STRUCTURES - SKELETON STEEL
Cal. Code Regs, tit. 8, § 1710(l)(7) (2011) - Employer was erecting a skeleton steel structure. A tightly planked and substantial floor was not maintained within two stories, or 30-feet under each tier of beams on which work was performed. The Division established a violation but it failed to support its ratings for severity and extent. 

ERECTION AND CONSTRUCTION - BRACING
Cal. Code Regs, tit. 8, § 1709(b)(1) (2011) - Employer was constructing a 65-foot tall skeleton steel building. Beams were not braced laterally as the construction progressed. The Division established a violation, reclassified it from serious to general, and reduced the penalty.

ERECTION OF STRUCTURES - COLUMN ANCHORAGE EVALUATED BY COMPETENT PERSON
Cal. Code Regs, tit. 8, § 1710(f)(1)(D) (2011) - Employer was constructing a 65-foot tall skeleton steel building. The vertical columns of skeleton steel were not evaluated by a competent person during erection to determine whether guying or bracing was needed. The Division established a violation, which it amended to classify as general.

ERECTION OF STRUCTURES - WORKING AND TRAVELING ON SKELETON STEEL OF MULTISTORY BUILDINGS OR STRUCTURES
Cal. Code Regs, tit. 8, § 1710(m)(2) (2011) - Employer was constructing a 65-foot tall skeleton steel building. An iron worker performing work other than connecting on the structure at a height greater than 30 feet was using fall protection equipment. The Division failed to establish a violation.

ERECTION OF STRUCTURES - FALL HAZARD TRAINING
Cal. Code Regs, tit. 8, § 1710(q)(2) (2011) - Employer was constructing a 65-foot tall skeleton steel building. Employer did not provide a training program for all employees exposed to fall hazards. The Division established a violation but failed to prove that it was properly classified as serious where it did not present evidence of the probability of serious physical harm or death if an accident occurred as a result of the failure to provide a training program. The violation was reclassified as general.

ELEVATED AERIAL DEVICES - EMPLOYEE SECURED TO BOOM, BASKET OR TUB
Cal. Code Regs, tit. 8, § 3648(o) (2011) - Employer was constructing a 65-foot tall skeleton steel building. An employee who descended in the basket of an aerial device was tied-off to the basket through the use of a body harness equipped with a safety lanyard. The Division failed to establish a violation.
