Code Regs, tit. 8, § 342(a) (2011) - The Division’s investigating safety engineer did not have personal knowledge of the events to which she testified. Statements that she recited from information in the Division’s case file were inadmissible hearsay. The employee who allegedly became ill at work did not testify. The Division failed to establish a violation.
