PENALTIES - FAILURE TO REPORT SERIOUS INJURY
Cal. Code Regs, tit. 8 § 342(a) (2011) - The Board upheld the ALJ’s reasonable inference that Employer purposely failed to report an injury, and affirmed the proposed $5,000 penalty. 

VIOLATION - SERIOUS CLASSIFICATION
Labor Code § 6432(a) (2011) - The Division properly classified as serious a violation for failure to ensure that a suitable push stick was provided and used by an injured worker. Employer failed to prove that it did not know, and could not have known with the exercise of reasonable diligence, that the worker would operate the table saw without using a push stick.
