Code Regs, tit. 8, § 4993(b) (2016) – The cited safety order did not apply to a test lift performed by Employer. “Swinging” refers to moving a boom through a horizontal arc, and there was no swing involved in the lift. Thus, no violation existed for failure to use tag or restraint lines to control a load that rotated during a hoisting operation.
