Cal. Code Regs, tit. 8, § 461(c) (2009) - Employer failed to post the required air tank permit.

INJURY AND ILLNESS PREVENTION PROGRAM (IIPP)
Cal. Code Regs, tit. 8, § 3203(a) (2009) - Employer did not have an IIPP at the time of inspection.

INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – SAFETY INSPECTIONS AND TRAINING RECORDS
Cal. Code Regs, tit. 8, § 3203(b) (2009) - Employer failed to maintain the required records.

ELECTRICAL - FLEXIBLE CORDS AND CABLES
Cal. Code Regs, tit. 8, § 2500.8(a) (2009) - A flexible cord was hanging over a wall and supplying electrical energy to another electrical item. Thus, the power strip was being used in lieu of fixed wiring.

FIRE PROTECTION - PORTABLE FIRE EXTINGUISHERS
Cal. Code Regs, tit. 8, § 6151(c)(4) (2009) - There was a discharged fire extinguisher at Employer’s place of business.

PERSONAL SAFETY DEVICES - EYE AND FACE PROTECTION
Cal. Code Regs, tit. 8, § 3382(a) (2009) - The parties stipulated to a serious violation. However, it appeared that Employer factually did not violate the statute. There was no evidence of employee exposure.

POINTS OF OPERATION AND OTHER HAZARDOUS PARTS OF MACHINERY- GUARDING
Cal. Code Regs, tit. 8, §§ 4070(a), 4300(a) and 4305(d) (2009) - The Division failed to prove that an employee was exposed to the dangers to which the cited regulations apply.

COMPRESSED GAS AND AIR CYLINDERS - SEPARATION AND STORAGE REQUIREMENTS
Cal. Code Regs, tit. 8, §§ 4650(d) and 4650(e) (2009) - There was no evidence of the possibility of an explosion if a cylinder tipped over.

FINANCIAL HARDSHIP
Employer failed to demonstrate that it was entitled to penalty relief.
