46 COR 40-8111 [¶22,904] CONSTRUCTION SAFETY ORDERS – INJURY AND ILLNESS PREVENTION PROGRAM (IIPP), METHODS AND/OR PROCEDURES FOR CORRECTING UNSAFE OR UNHEALTHY CONDITIONS, WORK PRACTICES AND WORK PROCEDURES Cal. Code Regs, tit. 8, §§ 1509(a), 3203(a)(6) (2019) – The Division failed to establish that Employer violated §1509(a). There was insufficient evidence that Employer’s IIPP did not include methods or procedures to correct unsafe working conditions. SAFE PRACTICES AND PERSONAL PROTECTION – PERSONAL SAFETY DEVICES AND SAFEGUARDS, HEAT ILLNESS PREVENTION, TRAINING Cal. Code Regs, tit. 8, § 3395(h)(1)(I) (2019) – The Division failed to establish a violation of the cited safety order. There was insufficient evidence that Employer failed to properly train its employees on the emergency procedures in its heat illness prevention plan.
