HEAT ILLNESS PREVENTION - WRITTEN PROVISIONS
Cal. Code Regs, tit. 8, § 3395(e)(3) (2011) - The Board rejected Employer’s argument that §3395 is unconstitutionally vague because it does not contain “triggering provisions” indicating when and under what circumstances the section applies. 

HEAT ILLNESS PREVENTION - EMPLOYEE TRAINING
Cal. Code Regs, tit. 8, § 3395(e)(1) (2011) - Employer’s failure to train an employee on heat illness or death more likely than not was a cause of the employee’s death. The Division established the serious, accident-related classification. The Board rejected Employer’s argument that §3395 is unconstitutionally vague.
