GENERAL PHYSICAL CONDITIONS AND STRUCTURES ORDERS – INJURY AND ILLNESS PREVENTION PROGRAM (IIPP), METHODS AND/OR PROCEDURES FOR CORRECTING UNSAFE OR UNHEALTHY CONDITIONS, WORK PRACTICES AND WORK PROCEDURES Cal. Code Regs, tit. 8, §§ 3203(a)(6), (a)(7) (2019) – The Appeals Board agreed with the ALJ’s finding that Employer failed to implement its written IIPP. Employer unsuccessfully contended that the length of the stock being cut using a punch press was an equivalent way of keeping an employee’s hand away from the point of operation. Employer also failed to establish that the injured employee was adequately trained. SAFE PRACTICES AND PERSONAL PROTECTION, MISCELLANEOUS SAFE PRACTICES – CONTROL OF HAZARDOUS ENERGY FOR CLEANING, REPAIRING, SERVICING, SETTING-UP, AND ADJUSTING OPERATIONS OF PRIME MOVERS, MACHINERY AND EQUIPMENT, INCLUDING LOCKOUT/TAGOUT, CLEANING, SERVICING AND ADJUSTING OPERATIONS Cal. Code Regs, tit. 8, § 3314(c) (2019) – The Appeals Board agreed with the ALJ’s finding that Employer failed to mechanically lock out movable parts. The employee did not de-energize the press before attempting to clear it, or call for help from his supervisor. SAFE PRACTICES AND PERSONAL PROTECTION, MISCELLANEOUS SAFE PRACTICES – CONTROL OF HAZARDOUS ENERGY FOR CLEANING, REPAIRING, SERVICING, SETTING-UP, AND ADJUSTING OPERATIONS OF PRIME MOVERS, MACHINERY AND EQUIPMENT, INCLUDING LOCKOUT/TAGOUT, TRAINING Cal. Code Regs, tit. 8, § 3314(l)(1) (2019) – The Appeals Board agreed with the ALJ’s finding that Employer failed to provide hazardous energy control training to an employee who operated a punch press. POINTS OF OPERATION AND OTHER HAZARDOUS PARTS OF MACHINERY – POWER OPERATED PRESSES, POINT OF OPERATION DEVICES Cal. Code Regs, tit. 8, § 4208(a)(1) through (a)(7) (2019) – The Appeals Board agreed with the ALJ’s finding that Employer failed to ensure that a punch press point of operation was protected. The distance between the activating button and the point of operation did not satisfy §4208(a)(5).
