The ALJ reduced the proposed penalty by applying the size, history, and good faith penalty-adjustment factors. ACCESS, WORK SPACE, AND WORK AREAS – PORTABLE LADDERS, CARE, USE, INSPECTION AND MAINTENANCE OF LADDERS, ACCESS TO LADDERS Cal. Code Regs, tit. 8, § 3276(e)(11) (2017) – Employer failed to ensure that a ladder extended not less than 36 inches above an upper landing surface.
