Appellant was in violation of 4070(c) for failing to adequately guard the nip points of a V-belt and pulley drive. The violation was classified as repeat since Appellant was found in violation of the same safety order on a previous occasion. The ALJ rejected Appellant's defense that the prior violation pertained to different equipment. A $215 penalty was affirmed.
