A repeat/general violation of 1509(b) (failure to post a Code of Safe Practices) and a $50 civil penalty were affirmed.
At the hearing, DOSH moved to reduce the penalty from $60 to $50. The basis for this motion was a recalculation of the penalty amount to reflect the Employer's prior history. Employer moved to withdraw its contest of the penalty amount, leaving as the only issue the existence of the violation.
