The Appeals Board reversed the ALJ decision of June 18, 1990 (Digest 17,415), insofar as that decision reduced the penalty from $250 to $50 for a permit violation.
The Board assessed the $250 penalty proposed by the Division, as recently mandated by the Legislature (in Labor Code 6511(a)) as a minimum for permit violations. The violation was of 341.1(e), which requires holders of annual excavation permits to notify the Division in a prescribed manner before starting work
