CAL. CODE REGS, tit. 8, §§ 1541(k)(1) and 1541.1(a)(1) (2001) - The Appeals Board agreed with the ALJ that Employer's foreman did not make an adequate inspection, as the term inspection is properly interpreted, nor did Employer provide cave-in protection in a trench that was less than 5 feet deep, but subject to conditions posing the possibility of a cave-in.
