One failure-to-abate penalty of $318,935 for a serious violation related to crane certification was eliminated because Employer established that the certification had been done, despite a manager's erratic handling of business affairs due to serious illness. A second failure-to-abate penalty of $39,810 for a general violation related to periodic inspection of cranes was upheld because Employer's owners could have known that their manager was not conducting proper inspections.
