HEARING – POST-SUBMISSION AMENDMENTS Board reg. § 386 (2014) – The ALJ did not commit error or exceed her authority by finding prejudice in the Division’s reclassification of a citation from serious to willful serious, and ordering further proceedings to allow Employer the opportunity to cure that prejudice. The Board affirmed the ALJ’s order after remand reopening the record.
