SERIOUS INJURY - REPORTING

CAL. CODE REGS, tit. 8, 342(b) (2000) - Employer did not report a serious injury accident to the Division as required by the cited safety order, a regulatory violation.

HEAD PROTECTION - HAIR CONFINEMENT

CAL. CODE REGS, tit. 8, 3381(d) (2000) - Employer's wire winding machine operator was not required to confine her hair in a way that would eliminate the hazard of entanglement, a serious violation that resulted in a serious injury. The independent employee action defense did not apply because she believed she was in compliance with her employer's safety rule concerning hair confinement.
