Untimely Filing for Reconsideration. The petition filed by Masters and Gregory, asking for reconsideration of a Notice of Dismissal dated May 6, 1975, was denied by the Board where 93 days had elapsed from the service of the dismissal order and the service on the Board of the Petition for Reconsideration.
Petitioner had 30 days within which to file a Petition for Reconsideration (Labor Code 6614(a)) plus a five-day extension pursuant to Code of Civil Procedure Section 1013(a).
