Exposure to the Hazard, No Employees Present. The appeal was granted and a citation dismissed for an alleged violation of Section 1647(a)(5) (failure to keep collapsible horse in good repair). No penalty had been proposed.

Appellant, a plastering subcontractor was found not to be in violation of the order where no employees were present on the job site and no inference of their exposure to the hazard could be drawn.
