Penalties, Mitigation. The safety engineer testified that he saw wiring was not enclosed or guarded to protect the wiring from excessive moisture. He also observed about 60 feet of low voltage open conductor lying on the ground. There was no Cal-OSHA notice posted at the site. This established nonserious violations of 1761(d), 1764(a) and 340. Appellant contested only the appropriateness of the $180 proposed penalty.
