Lack of Employee Exposure. Appellant manufactured automotive parts. At the time of inspection, the plant's machinery was being physically relocated to accommodate model year changes. Of 16 nonserious violations, three were contested on appeal. Alleged violations of 4052(a) and 3999(b) were dismissed by the Judge because of a lack of employee exposure to the alleged hazards. In both instances, the machinery was mechanically disconnected from its power source and was being physically relocated within the plant. A violation of 4070(c)
