The Aministrative Law Judge affirmed the $40 penalty and the citation for Appellant's failure to effectively guard floor openings with railings and toeboards in violation of 1632. However, Appellant could not be held to an abatement period of 16 days, where the citation was not issued until 21 days after the inspection, due to "inadequate notice" and the abatement period was vacated.
