On April 1, 1976, the Division issued Appellant a citation, based on an inspection of March 26, 1976, charging six non-serious violations of the code. Penalties were proposed in the amount of $90. After a reinspection on April 26, 1976, the Division charged Appellant with failing to correct the violation alleged under Item 5 of the earlier citation. An additional penalty was proposed in the amount of $1000. Appellant contested the existence of Item 5 of the citation and the additional penalty.
