Noise Control Safety Orders, Standard of Proof Required--Burden of Proof, Hearsay Evidence. This appeal contesting the alleged existence of a nonserious violation of 5099(a), together with the $55 proposed penalty, was granted. The Division failed to prove employee exposure to sound levels in excess of those permitted in 5097.

The Appellant was engaged in the business of fabricating nonmetallic pipe; the alleged conditions concerned an outside sawing and grinding operation.
