Although Appellant was in the food and restaurant business, it was engaged in construction at the site, remodeling a building to be used in part for the conduct of its food operations. Three visits to the site by the Division resulted in five citations alleging 16 nonserious, two repeat nonserious and one Notice of Failure to Correct violations of Construction Safety Orders, carrying total proposed penalties of $4,090. In granting three of the 13 items appealed, the Judge reduced the aggregate penalties to $1,455.
