Appellant was alleged to be in violation of 8 Cal. Adm. Code 4309(f). No penalty was proposed for the violation originally. Later, the Division issued a "Notice of Failure to Correct Alleged Violation and of Additional Civil Penalty" in the sum of $500.

At the hearing the Appellant withdrew its contest of the existence of the violations and the Division amended the proposed penalty to $250 in light of Appellant's having abated the condition.
