"The Appellant, Jack George Scaffold, was engaged in the business of erecting and dismantling scaffolds. Early in July 1976 Appellant erected the scaffold for painting the exterior of a church located on the corner of Duboce Street and Noe Street in San Francisco. The scaffold was constructed for a painting contractor, whose employees used the scaffold for two months while painting the exterior of the structure.
