One serious violation of 1541(e)(2) was established where the shoring in a 12 foot deep trench did not extend from the top of the trench and ended approximately four feet from the bottom of the trench. A $125 penalty was affirmed. A general violation was established where the uprights in this trench were spaced greater than six feet apart. No penalty was affirmed.
