A willful/serious violation of 3314(a) (stop or lock out machine while repairing) was reduced to a general violation and its $3,500 civil penalty was set aside. A serious violation of 3203(a)(1) (accident prevention program) and its $175 civil penalty were vacated. The inspection was occasioned by the fatality of a mechanic who had many years of experience on the machine, including its repair.
