The decision of the ALJ in this matter which established a serious violation of 4309(b) (Digest 12,491) was affirmed.
The Board said the Employer cannot now contest an admitted violation which it chose not to contest at the hearing, which was a serious violation based on the record for which the penalty proposed was reasonable.
