The Decision of the ALJ dated July 28, 1978 (Digest 12,816) was reinstated and affirmed to the extent that the appeal from a serious violation of 1621(a) (guardrails) and from the penalty of $315 was denied. The Decision was also affirmed as to the appeal granted from the violation of 4075 (sprocket guards) regarding unguarded chain and sprockets that powered the drive wheels.
