The Appeals Board affirmed the ALJ decision of December 9, 1982 (Digest 15,236) in part, granting Employer's appeal from an alleged serious violation of 3657(d) (elevating employees with lift trucks). However, the Board reversed the ALJ to affirm two other forklift violations, 3657(a) and 3659(a) (back guards). The 3657(a) violation was classified as serious, with a $300 penalty.
