The Appeals Board affirmed the ALJ decision of June 2, 1982 (Digest 15,010) in denying Employer's appeals from two violations of 1541(a) (trenches)--one serious, with $275 penalty, the other willful/serious with $6,500 penalty. The Board reversed the ALJ and granted Employer's appeal from an alleged serious violation of 1540(n) (excavations, general) with proposed $135 penalty.
