The Appeals Board reversed the ALJ decision of October 29, 1981 (Digest 14,719), insofar as that decision held that a general violation of 1646(c) (tower scaffolds and rolling scaffolds, wood or metal) was not a repeat. The Board approved the $35 penalty proposed by the Division, on whose petition the matter was reconsidered.
