The Appeals Board reversed the portion of the ALJ decision of August 26, 1996 [Digest 19,009], which had reduced a charged willful/serious violation of 2320.2(a) to serious and its $40,000 penalty to $4,000. Reconsideration of the willful/serious classification was on the Board's own motion.
