Employer, a construction contractor erecting steel framing on an airport terminal, received a planned inspection, after which the Division cited for a serious violation and proposed a $2,250 penalty. At the hearing the Division moved to reduce the serious classification to general and the penalty to $335 because there was insufficient evidence to prove a substantial probability that serious harm or death would result from the violation.
