LOGGING - FELLING DANGEROUS TREES AND SNAGS
CAL. CODE REGS, tit. 8, § 6259(a) (2002) - Employer's rigger in charge of a logging crew could have anticipated that part of the rigging to drag logs would contact a dead tree and cause it to fall, resulting in a serious injury. The safety order's language was not vague or uncertain. The independent employee act defense was not available because the crew's leader, not the injured employee, was responsible for the violative action.
