SCAFFOLDS - END RAILS
Cal. Code Regs, tit. 8, § 1644(a)(6) (2003) - Employer's foreman worked on a scaffold platform nearly 12 feet above ground that lacked rails on either end. However, the Division provided no evidence to establish the serious classification and the violation was reduced to general.
VIOLATION - SERIOUS CLASSIFICATION
A violation's serious classification could not stand where the Division failed to present any evidence that there was a substantial probability of serious harm or death from a fall from the upper platform of a scaffold. <</P>
