The fact that Employer had filed for bankruptcy did not automatically stay the appeal proceedings before the Board.

Cal. Code Regs, tit. 8, § 372 (2004) - The ALJ declined to exclude Employer's witnesses because it failed to provide the Division with its list of witnesses. The Division had led Employer to believe it had more time to respond, and the Division also failed to provide Employer with the name of one witness.
