PENALTIES – SERIOUS CLASSIFICATION
Cal. Code Regs, tit. 8, § 361.3, Labor Code § 6432(a), (c) (2018) – Employer did not appeal the existence of the cited violations, which were established by operation of law, and which the Division properly classified as serious. Employer failed to rebut the presumption of a serious violation for each citation at issue. The ALJ affirmed the proposed penalties.
