Cal. Code Regs, tit. 8, § 3385(a) (2018) – Reversing an ALJ decision, the Appeals Board concluded the Division established a serious, accident-related violation for failure to require appropriate foot protection for employees exposed to foot injuries.
DEFENSES – UNFORESEEABLE EXTREME DEPARTURE
Employer failed to properly raise the unforeseeable extreme departure defense in its pleadings. Moreover, there was insufficient evidence the injured employee departed from any reasonable understanding of his work duties, or that he knew his work activities did not encompass the activity at issue.
