Excavation Permit. A $50 proposed penalty for an alleged failure to renew an excavation permit was vacated.
"Appellant's failure to renew his permit appears to have been the result of a bona fide misunderstanding of its time of expiration. Moreover, a loss of $800 to the company during the shutdown of the job while the permit was renewed is penalty enough under the circumstances."
