Digest of COSHAB's Decision After Reconsideration dated May 22, 1985, Docket No. 83-R4D2-587. Elaine W. Donaldson, Chairman; L. A. Harrington and Alfred H. Song, Members.

The Appeals Board affirmed the ALJ decision of December 28, 1983 (Digest 15,633), denying Employer's appeal from a serious violation of 1596(a) (seatbelts, nonuse). The Board held that Employer could not assert prejudice in the Division's failure to furnish requested discovery until the morning of the hearing. The Board also held that the evidence supported the ALJ's findings, despite evidentiary contentions raised by Employer for the first time on reconsideration.
