The Appeals Board affirmed the ALJ decision of March 16, 1984 (Digest 15,706), denying Employer's appeal from a repeat/serious violation of 1644(a)(5) with $1,000 penalty. On reconsideration, the only issues were whether Employer was prejudiced by delay in setting its appeal for hearing before the ALJ, or by the Division's delay in complying with Employer's discovery requests.
