Cal. Code Regs, tit. 8, § 4307(c) (2004) - A portable circular saw had the guard pinned back in an inoperable position. The evidence was sufficient to establish the serious violation, although an employee attempted to prove he was merely going to change the blade. However, there was no evidence to support a repeat classification.
