As a special or dual employer, Employer had some control of workers employed by a contractor it hired to monitor and protect digging near its fiber optic cable beside a roadway, and was responsible for some, but not all, safety requirements impacting their work. It was responsible for implementing the safety procedures in its own Injury and Illness Prevention Program that related to contracted employees. However, it was not responsible for providing the workers with traffic control equipment and first aid materials.
