The Appeals Board set aside the ALJ decision of September 30, 1996 [Digest 19,015], granting Employer's appeal to the extent of reducing the classification of a serious violation to general and the $5,000 penalty to $500.
Following an accident investigation, the Division cited for a serious violation related to forklift platform guardrails and proposed a $5,000 penalty. Employer's appeal was denied by the ALJ.
