CAL. CODE REGS, tit. 8, 4296(m) (2001) - Employer's finger-joint machine did not have a guard under the table to prevent accidental contact. The independent employee action defense did not apply to the guarding violation. However, the serious classification was inappropriate because the condition was not discoverable with reasonable diligence.
