CA Supreme Court Says Safety/Fire Brigade Members – Can Sue Third Party for Injuries

SACRAMENTO - In a unanimous decision the California Supreme Court has held that Craig Neighbarger and John Magana, who were injured on the job when a fireball erupted because of the negligence of a maintenance subcontractor (Irwin Industries), can sue Irwin for their injuries.Neighbarger and Magana were Powerine Oil employees. As safety supervisors, they were in the company fire brigade but had other duties. At the time of the accident, they were engaged in work assignments other than fire fighting.
