Penalties, Reasonableness, Purpose of---Excavations, Shoring. The appeal was granted to the extent that the proposed civil penalty was reduced from $600 to $200 for the alleged "serious" violation of T8 CAC Section 1540, a safety order requiring adequate shoring in excavations more than five feet deep.

The Board reduced the penalty where it was found that Appellant had a good safety record, had demonstrated safety consciousness over the years, and where the trench in question was not expected to exceed five fee
